Judge strikes down NYC sugary-drinks limit
A New York State judge has halted the controversial New York City ban on large sugary drinks...The ban was set to take effect Tuesday...It would put a 16-ounce cap on sweetened bottled drinks and fountain beverages sold at city restaurants, delis, movie theaters, sports venues and street carts.
On Sunday, Bloomberg defended the regulation. "We're not banning anything," he said on CBS' Face the Nation. "It's called portion control."...But on Monday, a judge said no to the rule. Manhattan state Supreme Court Justice Milton Tingling wrote that loopholes "effectively defeat the stated purpose."
Bloomberg's office took to Twitter to express its disappointment in the decision. "We plan to appeal the sugary drinks decision as soon as possible, and we are confident the measure will ultimately be upheld," it tweeted soon after the annoucement...Later, it tweeted: "We believe @nycHealthy has the legal authority and responsibility to tackle causes of the obesity epidemic, which kills 5,000 NYers a year."
"I'm relieved," said Russell Levinson, general manager of Movieworld in Queens...The legislation had opened up "the possibility of (Bloomberg) or someone like him -- or the health department -- creating similar laws on candy or popcorn," he said. "It's opening up a door that can lead to the government really telling you what you can and can't drink and eat."

Soda ban struck down by Judge "Tingling"? Tingling - like the sensation of drinking a soda? How mockingly appropriate. The name game [link], again, is proof - not that there was ever any doubt anyway - that this is nothing more than another scripted production to achieve an end goal. The end goal being absolute control over the "inferior races", i.e. the cattle. [see: 'follow up' above]
Simply banning a single product, like soda, provides only a limited measure of control. This was never the intent in the first place in introducing the ban. It was only a stepping stone to achieve the greater goal which is the setting of a much wider precedent. This would require exactly what is happening here. The ban would have to first be struck down, and then appealed to a higher court, as now seen, where the "legal authority and responsibility" of the 'Government' to deal with "the causes" of an "epidemic...which kills" could then be argued.
By doing this the issue is reframed in the context of 'public safety'. See, it's not about sodas per se, it's about 'killer epidemics', and everybody knows you can not allow killer epidemics to just run rampant*, meaning the government has to step in and do something about it...is where this is now going. Once this is played out - and does anybody think for a moment that it won't? - a huge new precedent will have been created. To keep the 'herd' safe, legal authority and responsibility for the well being of the 'cattle' [link] will have been 'legally' transferred to the 'ranchers'.
